Legal due diligence before buying property in Türkiye

A property lawyer reviews the legal position of a proposed purchase before completion. IGA Law helps international buyers identify issues affecting ownership, transferability and the intended use of a Turkish property, alongside the transaction documents they are asked to sign.

Can foreigners buy property in Türkiye?

Eligible foreign nationals can buy property in Türkiye, subject to nationality, location and other legal restrictions. A buyer’s ability to acquire a particular property should be checked before payment. Ownership is completed through the legally required transfer and registration process; a reservation or preliminary agreement alone does not transfer title.

Can buying property qualify an investor for Turkish citizenship?

A qualifying property investment may support a Turkish citizenship application, but buying a property does not automatically confer citizenship. The transaction must meet the applicable investment, ownership, documentation and holding conditions. The relevant authorities review the investment and application, so eligibility should be assessed before a purchase is committed.

Can a spouse and children apply with the investor?

A spouse and children who meet the applicable family eligibility rules may be considered alongside an eligible investor. Each family member’s identity, relationship and legal circumstances need to be documented. Age, dependency and any relevant consent or custody issues require individual assessment; approval of one family member does not remove the checks required for another.

Is residence in Türkiye required during the investment citizenship process?

Personal attendance in Türkiye may be required for procedural stages, including identity and biometric checks; the investment route should not be confused with a promise of a fully remote process. The appropriate residence-permit and citizenship stages need to be coordinated for the applicant’s circumstances. Plan travel and appointments using the current requirements confirmed for the file.

Can procedures be handled through a power of attorney?

A properly drafted power of attorney can authorize representation for permitted procedures, but it does not replace every personal obligation. Its scope, form, authentication and Turkish translation must suit the transaction. Identity checks, fingerprints or other attendance requirements may still apply, so the tasks that can be delegated should be agreed before the document is issued.

Why is legal due diligence important before buying property?

Legal due diligence helps a buyer identify issues in title, registered burdens and transaction documents before completing a purchase. These issues can affect ownership, transfer or the intended investment use. Where citizenship is planned, suitability for that separate application also needs consideration. A review supports informed decisions; it does not eliminate market risk or guarantee approval.

How can a Turkish lawyer assist a foreign property investor?

A Turkish lawyer can review the proposed transaction, explain contractual obligations and coordinate the legal documents and permitted representation involved in the acquisition.
